Josh Borsellino is the Managing Attorney of Business Litigation at Bailey & Galyen. He represents businesses and consumers in a wide variety of matters, including the prosecution and defense of claims for fraud, breach of contract, and negligence, as well as violations of the DTPA and intellectual property statutes. Mr. Borsellino has worked on many complex business disputes across the state of Texas. These matters have included:

  • Representing a chemical company in a suit by a former customer for allegedly defective goods, in which the former customer sought more than $10 million in damages. Summary judgment was granted in favor of the client, and this ruling was affirmed by the U.S. Court of Appeals for the Fifth Circuit.
  • Representing a royalty interest owner against an operator that claimed that the lease was held by “force majeure.” The district court granted summary judgment against the operator, resulting in the release of the lease.
  • Representing a nursing home provider against a subcontractor for faulty design and installation of a sprinkler system, resulting in a favorable settlement.
  • Representing a company that had been defrauded through a Ponzi scheme, resulting in an arbitration award in excess of $1 million.

Mr. Borsellino received his undergraduate degree from Southwestern University. He received his law degree from Tulane Law School. Upon graduation from law school, Mr. Borsellino completed a two-year term as a briefing attorney for the Honorable Walter S. Smith, Jr., U.S. District Judge for the Western District of Texas. While clerking for Judge Smith, Mr. Borsellino drafted countless briefs focusing on evidentiary rulings and dispositive motions under state and federal law. Prior to working at Bailey Galyen, Mr. Borsellino was a commercial litigation attorney at Haynes and Boone, LLP.
